Cosmetic surgery crackdown will improve patient safety

Maurice Blackburn Lawyers has today welcomed new laws that will place tougher restrictions on the cosmetic surgery industry in Victoria.

Under the new laws, day procedure facilities that perform cosmetic surgery will be required to undergo the same regulation as other surgeries.
 
Maurice Blackburn principal Dimitra Dubrow, who heads the firm’s Victorian medical negligence practice, said the move would improve safety for patients who currently face unregulated and potentially risky surgeries.
 
“All surgeries are serious medical procedures – and cosmetic surgeries are no exception.
 
“However, day facilities were previously able to escape regulation if cosmetic surgery was not their main activity.
 
“In our work, we’ve seen far too often the terrible consequences of unregulated and poorly performed cosmetic surgery.
 
“These new laws are an important step in improving safety for Victorian patients.”
 
The Health Legislation Amendment (Quality and Safety) Bill, to be introduced into Parliament today, delivers on recommendations from Dr Stephen Duckett’s review into the Victorian hospital system.
 
Dr Duckett’s state-wide review was commissioned by the Victorian Government after the discovery of a cluster of potentially avoidable newborn and stillborn deaths at Djerriwarrh Health Services.
 
Ms Dubrow, who acts for a number of families affected by the tragic cluster of deaths at Djerriwarrh, said it was positive to see changes implemented following the review.
 
“We welcome the move to hold private hospitals to tougher patient safety and reporting standards,” she said.
 
“All Victorian patients should be able to expect the same level of care no matter whether they attend a public or a private health facility.
 
“New laws around the appointment of hospital board members, and steps to improve information sharing and risk assessments, are also welcomed.”
